Silly lawsuits

Sat Oct 3, 2009, 11:55 AM
I know I will probably get some flack from people who THINK they understand the constitution of the United States for this, but I care not. Most people who shroud themselves in "The Constitution" do not really understand it.

My former university is apparently being sued by a conservative student group for a freedom of speech violation. The group in question publishes an unofficial conservative student newspaper. The group has been allowed to publish it, and no members of said group have ever been arrested for their involvement in said newspaper. What is at issue is distribution. Distribution issues in a freedom of speech lawsuit should automatically raise a red flag for those who truly understand the first amendment. I don't recall reading anywhere that on public property (such as a State University) any organization should be allowed to distribute anything. That aside, the paper IS distributed on University grounds. There is a location where ALL unofficial student newspapers can be distributed. It is not exactly on the 12th floor of the Empire State building either. In this particular case, the group publishing said paper was placing distribution bins all over campus. This is in clear violation of the campuses distribution policy. They were asked to remove the bins, and when they refused the bins were removed by campus employees.

Keep in mind that none of the unofficial student newspapers are allowed to distribute their materials in this manner. If for no other reason, allowing this would be seen as state promotion of the ideas in said newspapers.

I guess people in general need to get the idea out of their heads that Freedom of Speech is an all encompassing unlimited right with regards to all aspects of speech. If I own a piece of property, am I required to let somebody else distribute a newspaper on it? Unlimited distribution everywhere is not part of speech folks. This group is allowed to distribute their paper in a specific location, they are also allowed to hand deliver said paper to interested students individually.

When there members start getting arrested for publishing said rag, then they can bring on the lawsuit. Until then this lawsuit remains silly.

I was going to...

Write a journal about something. But I forgot what. It was important. At least at one time when I was originally going to write it. But I can't recall now what it was about. It's importance has probably passed.
